In layman’s terms an immigrant quota work permit dictates how many foreign nationals are permitted to work in a particular institution.
All required permits must be obtained prior to arrival in Ghana and applications will not be considered for work permits from persons who are in the country as visitors.
Who qualifies for an Immigrant Quota work permit?
All investment-related quotas, except for the petroleum and mining sectors, are regulated by section 30 of the Ghana Investment Promotion Centre Act, 1994 (Act 478), as follows:
- Enterprises with a paid-up capital of between US$10,000.00 and US$100,000.00 (or equivalent in cedis) are entitled to an initial automatic maximum immigrant quota work permit of one person.
- Enterprises with paid-up capital of between US$100,000.00 and US$500,000.00 (or equivalent in cedis) are entitled to an initial automatic maximum immigrant quota work permit of two people.
- Enterprises with paid-up capital of US$500,000.00 or more (or its equivalent in cedis) are entitled to an initial automatic maximum immigrant quota work permit of four people,
- All applications for immigrant quota work permits with respect to investment (other than the petroleum and mining sectors) should be submitted to the Ghana Investment Promotion Centre and dealt with by the Immigration Service in consultation with GIPC. The Minister grants immigrant quotas for petroleum and mining enterprises, as well as churches, in consultation with the relevant government institutions.
Period of validity for an Immigrant Quota work permit
The approval of an Immigrant Quota work permit will specify the period for which a foreign national may occupy a particular post. Importantly it must be remembered that a Ghanaian understudies the work permit holder to take over on expiry of an Immigrant Quota work permit.
The decision making process for an Immigrant Quota work permit
The decision to whether to grant an Immigrant Quota work permit and the details therein is made by the Immigrant quota committee. The committee is made up as follows:
(a) the Deputy Minister who is the chairman;
(b) the Director of Immigration or his representative not below the position of a Deputy Director; and
(c) a representative of the:
(i) Ministry of the Interior;
(ii) Ministry of Employment and Social Welfare;
(iii) Ministry of Trade and Industry;
(iv) Registrar-General’s Department;
(v) Ghana Investments Promotion Centre;
(vi) Bank of Ghana;
(vii) Statistical Service; and
(viii) Ghana Employers Association.
What the Immigrant Quota Committee decides
The committee makes recommendations on the merits of all applications for an Immigrant Quota work permit and work permit. In turn it will submit these recommendations to the appropriate minister who may issue an Immigrant Quota work permit or work permit in accordance with the current laws of Ghana.
What is considered in an application for an Immigrant Quota work permit
- That the applicant is qualified to work or undertake employment in the trade, business or profession in respect of which the application is made;
- That such employment will be to the benefit generally of Ghana; and
- That the individual is lawfully resident in Ghana and is qualified to work as an employee or as a self-employed person.
